These terms and conditions ("Terms") govern your access to and use of the NeuroBet mobile application ("the App") provided by NB Analytics ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, please refrain from using the App. Acceptance of Terms By using the NeuroBet App, you acknowledge that you have read, understood, and agreed to comply with these Terms. These Terms constitute a legally binding agreement between you and NB Analytics. Use of the App a. Eligibility: You must be at least 18 years old or of legal age in your jurisdiction to use the App. By using the App, you represent and warrant that you meet this requirement. b. Personal Use: The App is intended for personal and non-commercial use. You may not use the App for any unauthorized or illegal purpose. c. Account Creation: In order to access certain features of the App, you may be required to create an account. You agree to provide accurate and complete information during the registration process and to keep your account information up to date. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Intellectual Property a. Ownership: The App and all its content, including but not limited to text, graphics, logos, images, and software, are the property of NB Analytics or its licensors and are protected by intellectual property laws. b. Limited License: NB Analytics grants you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not reproduce, modify, distribute, display, or create derivative works of the App or its content without our prior written consent. Privacy a. Collection of Information: By using the App, you consent to the collection, storage, and use of your personal information as outlined in our Privacy Policy. b. Data Security: We implement reasonable security measures to protect your personal information. However, we cannot guarantee the absolute security of data transmitted over the internet or stored electronically. You acknowledge and accept the associated risks. Disclaimer of Warranty a. The App is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the App's operation, functionality, or availability. b. We do not warrant that the App will be error-free, uninterrupted, or free from viruses or other harmful components. You agree to use the App at your own risk. Limitation of Liability a. To the fullest extent permitted by applicable law, NB Analytics and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of the App. b. In no event shall our total liability to you for all damages, losses, or causes of action exceed the amount paid by you (if any) for accessing or using the App. Modification and Termination a. We reserve the right to modify or discontinue the App, in whole or in part, at any time without prior notice. b. We may also modify these Terms from time to time. The most current version of the Terms will be posted on the App. Your continued use of the App after any modifications indicates your acceptance of the updated Terms. Governing Law and Jurisdiction These Terms shall be governed by and construed in accordance with the laws of Wyoming. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Wyoming. Severability If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Entire Agreement These Terms constitute the entire agreement between you and NB Analytics regarding the NeuroBet App and supersede all prior or contemporaneous agreements, understandings, or representations, whether oral or written.
